2.1 Purchase procedure

You can browse the website until you find the item you want. Once located, clicking on it will give you access to all the detailed information that the website offers. From there you can add the item to your cart.

When placing your order you will be asked to enter all your details and finally confirm the order.

Once the purchase procedure has been completed, you can select whether you wish to generate an electronic invoice, which will be sent to the User via email. You can also request a paper copy of your invoice. From the management panel of your account, the User can also download the invoice.

2.4 Contract with EUROALIMENT QUALITY FOOD SUPPLIER, SLU and acceptance of orders.

2.5 Confirmation and cancellation of orders

2.8 Deliveries: types, deadlines and problems

Once payment has been received, your order will be prepared. You can choose whether you want it delivered to a postal address or picked up at our physical store.

If you order before Xh, your order will be ready within 24 hours (working days). Order processing hours are from 09:00 to 16:00, every working day from Monday to Friday. Orders placed outside this time frame will be processed on the next working day.

Shipping to the Peninsula (Spain, Andorra and Portugal)

As a general rule, packages are sent within 24/48 hours (working days) after receipt of payment, via a selected courier service.

Except in cases where there are unforeseen or extraordinary circumstances or, where applicable, arising from the customization of the products, the purchase order consisting of the products listed in each purchase confirmation will be delivered within the period indicated on this website according to the shipping method selected by the User and, in any case, within a maximum period of 30 calendar days from the date of the order confirmation.

If, upon delivery, the packaging of your order is damaged, you must open the package in the presence of the logistics operator to check the condition of the items. If damage is observed, you must detail it on the delivery note and contact us. We will repair or replace, free of charge, all items that have been damaged or lost during transport, provided that you notify us of the incident as soon as possible.

Once the order has been delivered, it will become your property and therefore any damage that may arise will be your responsibility.

2.9 Return, withdrawal, exchange and refund policy

2.9.1 Returns

In cases where the User purchases products on or through the owner's Website, he or she has a series of rights, as listed and described below:


2.9.2 Right of Withdrawal

The User has the right to withdraw from this contract within a period of 14 calendar days without giving any reason. The withdrawal period will expire 14 calendar days after the day on which you or a third party indicated by you, other than the carrier, acquired physical possession of the goods.

To exercise the right of withdrawal, the User must notify EUROALIMENT PROVEEDOR DE ALIMENTOS DE CALIDAD, SLU, info@grup-pons.com, of their decision to withdraw from the contract through an unequivocal statement. You may use the withdrawal form template below, although its use is not mandatory.

To meet the withdrawal deadline, it is sufficient for the User to send the communication regarding the exercise of this right before the corresponding deadline expires.

Consequences of withdrawal:

In the event of withdrawal by the User, we will refund all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the least expensive standard delivery method offered by us) without undue delay and, in any case, no later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will proceed to make said refund using the same means of payment used by the User for the initial transaction, unless the User has expressly provided otherwise; in any case, you will not incur any costs as a result of the refund.


“You must send and return or deliver the goods directly to EUROALIMENT PROVEEDOR DE ALIMENTOS DE CALIDAD, SLU, POL. IND. AL KANIS NAU A CTRA. N-230 KM. 11,2 - 25124 - ROSELLÓ (LLEIDA)” or “We will collect the goods”, without undue delay and, in any case, no later than 14 calendar days from the date on which you notify us of your decision to withdraw from this contract. The deadline will be deemed to have been met if you return the goods before said deadline has expired.

You will be responsible for the direct cost of returning the goods.

The User must return the Products in perfect condition, otherwise the product may suffer a depreciation. Consequently, the User is informed that he/she will be responsible for the decrease in value of the products resulting from handling other than that necessary to establish the nature, characteristics and functioning of the goods. That is, if the product is not returned with the original packaging or in perfect condition, EUROALIMENT PROVEEDOR DE ALIMENTOS DE CALIDAD, SLU may charge the cost of the devaluation of the product.


The User acknowledges that there are exceptions to the right of withdrawal, as set out in article 103 of Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws. By way of example, and not exhaustively, this would be the case of: goods made according to the specifications of the consumer and user or clearly personalised, the supply of goods that may deteriorate or expire quickly, the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene and that have been unsealed after delivery, the supply of goods that after delivery and taking into account their nature have been inseparably mixed with other goods.


2.9.2 Return of defective products or shipping errors

These are all those cases in which the User considers that, at the time of delivery, the product does not comply with the provisions of the contract or purchase order, and that, therefore, he/she must contact EUROALIMENT PROVEEDOR DE ALIMENTOS DE CALIDAD, SLU immediately and inform it of the existing non-conformity (defect/error) by the same means or using the contact information provided in the previous section (Right of Withdrawal).

The User will then be informed on how to proceed with the return of the products, and these, once returned, will be examined and the User will be informed, within a reasonable period of time, whether a refund or, where appropriate, a replacement of the same is appropriate. The refund or replacement of the product will be made as soon as possible and, in any case, within 14 days following the date on which we send you an email confirming that a refund or replacement of the non-conforming item is appropriate. The contracting of the services offered will be carried out between the User and EUROALIMENT PAC, SLU. The User, at the time of formalizing the reservation, will establish a direct contractual relationship with EUROALIMENT PAC, SLU.

BOOKING

In order to make reservations through the Website, the User must provide personal data (name, surname, email and telephone number), or, where applicable, the data of the person on whose behalf the activity is being reserved so that EUROALIMENT PAC, SLU can make the reservation requested by the User.

Pursuant to these General Terms and Conditions, Users declare that they provide true, accurate, current and complete data about their identity, or, where applicable, about the person on whose behalf the activity is booked. In this regard, Users shall be responsible for the accuracy of the data provided to EUROALIMENT PAC, SLU and for any consequences that may arise from errors in the information provided.

In general, the reservation of activities, excursions and guided tours promoted by EUROALIMENT PAC, SLU through the Website is subject to the following conditions:

The dates and times of the activities, excursions and guided tours published on the Website have been defined and do not allow any type of modification in this regard.

The possibility of changing the date and time of an activity, excursion or guided tour would only be possible if the User hires a private service. The minimum advance notice for each reservation varies depending on the activity, excursion, guided tour and/or experience you wish to book. This specific aspect can be seen in the activity's information sheet on the Website. EUROALIMENT PAC, SLU informs you that it is not possible to book an activity with less advance notice than that indicated in the corresponding activity's information sheet.

EUROALIMENT PAC, SLU reserves the right to use images of participants taken during activities, excursions and guided tours promoted by the entity.

We inform you that within the framework of the activity in which you are registered, images will be captured and may be published for dissemination. Likewise, you accept the promotion, distribution and exploitation of the images throughout the world through any means of communication (Internet, advertising, etc.) and without time limit. Those registered expressly grant the organization the right to reproduce their image. You authorize the publication of images captured within the framework of the activity.

Specific conditions

The meeting point, date, time, duration and all the information necessary to enjoy the activity, excursion and/or guided tour booked is detailed in the description sheet for each service/experience on the Website, as well as in the confirmation email that EUROALIMENT PAC, SLU will send to the User once the booking has been made.

In addition to providing all the information about the reserved service, the confirmation email contains proof of reservation for the activity, excursion and/or guided tour contracted.

It is essential that Users are punctual and present themselves at the meeting point at the time and date indicated on the voucher, since all activities, excursions and guided tours are scheduled to depart at a specific time and it is not possible to modify the start time.

The duration of the activities, excursions and guided tours published on the Website are for reference purposes only and may be subject to slight variations depending on the development of the service itself, such as, for example, inclement weather, traffic problems, strikes, etc.

EUROALIMENT PAC, SLU informs you that it may require you to submit proof of reservation of the activity prior to the start of the activity, and this must be presented in paper or digital format. If the user does not present proof of reservation, he/she will not be able to participate in the activity, excursion or guided tour.

RESERVATION PROCEDURE

HIRING

All services are confirmed immediately and are paid at the time of booking by:

The amount of the order will be charged to your card, so you must provide us with the number, the expiry date and the CW2 security code (on the back of your card). In the event that your card is scanned, you will be asked for the relevant security codes.

In general, EUROALIMENT PAC, SLU makes the full payment through the Website for the activity, excursion and/or guided tour by the User.

These prices are expressed in Euros (€) and include taxes, and the total amount will be indicated at the time of final confirmation of the contracting of the service.

In general, EUROALIMENT PAC, SLU will not apply discounts on the provision of its services, unless this is established in the conditions of the corresponding activity, excursion and/or guided tour.

CONFIRMATION AND CANCELLATION OF RESERVATIONS

After making the reservation, Users will receive a confirmation email confirming payment for the contracted service and will be provided with a receipt/acknowledgement of purchase for the contracted services. Users must bear in mind that this receipt of purchase is not equivalent to the issuance of the invoice corresponding to the contracting of the services. Users may request the invoice, in paper or electronic format, once they have made their reservation through the website by emailing pons.shop@grup-pons.com.

In the event of any improper or fraudulent charge to the card used for the purchase through https://ponshome.es, EUROALIMENT PAC, SLU will be able to take the appropriate action as soon as possible.

CANCELLATION POLICY

– Visit and wine tasting: with 48 hours’ notice you can change the date of the event free of charge, but the amount will not be refunded. In case of not showing up for the visit you had booked, you will lose 100% of the amount paid. The amount of the visit will not be refunded even if you notify us 48 hours in advance of the day of the visit.

– Special events (Harvest days, Arbequina Day, Dinner among vineyards, Cultural proposals and pairing,…): 50% of the amount will be refunded for reservations cancelled 3 days before the event. For reservations cancelled less than 3 days before the event, 100% of the amount paid will be lost. Changes of date will not be accepted.

– Activities and events for groups and/or companies. 50% of the amount will be refunded for reservations cancelled 7 days before the event; for reservations cancelled less than 7 days before the event, 100% of the amount paid will be lost.

The company reserves the right to cancel or modify dates if a minimum capacity is not reached or due to force majeure.

In accordance with the above, and by accepting these general booking conditions, users declare that they have read and expressly accepted this cancellation policy and agree with the cancellation conditions of the activity, excursion and/or guided tour that they book through the website.

GIFT VOUCHER

Gift Vouchers include any activity, excursion and/or guided tour not completed.

You will have one year to redeem it by reserving the desired date and time, as long as it is available.

The gift voucher will be sent by email in PDF format within a maximum of 48 hours after receiving your request.

The information included in the gift voucher will be necessary for the enjoyment of the activity, excursion and/or guided tour, and is detailed in the description sheet for each service/experience on the Website, as well as in the confirmation email that EUROALIMENT PAC, SLU will send to the User once the reservation gift voucher has been purchased.

This will be sent by email, which will be the confirmation, in addition to providing all the information about the reserved service, it is the proof of reservation of the activity, excursion and / or visit included in it.

CONDUCT ON THE WEBSITE

 

Users undertake to make lawful, diligent, honest and correct use of any information or content they have access to through the Website, and all of this under the principles of good faith and respecting at all times the current legislation and these General Terms and Conditions of Contract. In particular, but without limitation, Users must not:

Registering or communicating data that is not true, accurate, complete and/or up-to-date, or accessing the Website using the name, identification data or password of another User or impersonating any person or identity.

Use the Website for fraudulent purposes, or in connection with criminal offences or unlawful activities of any kind.

Introduce or spread computer viruses that may cause unauthorized alterations to the contents or systems comprising the Website.

Create a Profile or use the Website to use or reuse any material that is unlawful, offensive, pornographic, abusive, indecent, defamatory, obscene or threatening of any kind, or that constitutes a violation of copyright, trademarks or confidentiality, privacy or any other right, or is otherwise libelous or objectionable to any third party.

Download, send or otherwise distribute content or applications that may violate any applicable law or infringe any rights of any party.

EUROALIMENT PAC, SLU reserves the right to deny any attempt to access the Website or cancel user accounts in cases where there is incorrect use of the Website in accordance with the provisions of this clause.

DISCLAIMER

Without prejudice to the responsibility in the reservation of activities, excursions and guided tours to which the provisions of the General Law of Consumers and Users apply and by way of example, but not limited to, EUROALIMENT PAC, SLU is not responsible for the following circumstances:

Regarding cancellations made outside the deadline by Users. EUROALIMENT PAC, SLU will not be responsible under any circumstances for returning the amounts paid by its Users when they have not complied with the cancellation deadline provided for in the cancellation policy.

For any delays or errors made by Users in arriving at the meeting point for the reserved activity, excursion and/or guided tour. EUROALIMENT PAC, SLU will not assume any responsibility if the User misses the reserved activity due to lack of punctuality and/or not being at the corresponding meeting point.

In cases where the User does not carry the corresponding proof of reservation printed on paper and/or downloaded to his/her mobile phone and is denied access to the corresponding activity, excursion and/or guided tour.

Of any injuries, damages and accidents that the User may suffer while enjoying the reserved activity, excursion and/or guided tour, as well as any injuries, damages and accidents suffered by the User prior to the service and which prevented him/her from enjoying it.

The weather conditions in which the activities, excursions and guided tours booked by the Users are carried out. EUROALIMENT PAC, SLU will not be responsible for these circumstances under any circumstances, so the service will be deemed to have been correctly provided.

In cases where the activities, excursions or guided tours have been completed with respect to all the points of interest included in them, even if the duration has suffered a slight variation due to any external factor. In this situation, it will be understood that the service has been correctly provided.

MODIFICATIONS

EUROALIMENT PAC, SLU reserves the right to make as many changes as it deems appropriate to these General Terms and Conditions. These changes will be valid from the moment they are published on the Website.

SAFEGUARD CLAUSE

All clauses or provisions of these General Terms of Use must be interpreted independently and autonomously, and the rest of the stipulations will not be affected if one of them has been declared void by a final court ruling or arbitration decision. The affected clause or clauses will be replaced by another or others that preserve the effects sought by the General Terms of Contract.

Applicable law and jurisdiction

This site is located and operated in Spain. These General Terms and Conditions of Contract shall be governed by Spanish law. All matters relating to this site are governed by Spanish law and are subject to the jurisdiction of the competent Courts and Tribunals of Spain, without the principles of conflicts of laws being applicable.

In those cases where the client does not have the status of consumer or user, or has a domicile outside of Spain, he/she will be subject to the Courts and Tribunals of Lleida, expressly waiving any other jurisdiction that may apply.

If the user decides to use or consult this site outside of Spain, he or she must bear in mind that he or she does so on his or her own initiative and is responsible for compliance with the relevant laws.

This contract will enter into force and have full effect from the moment of acceptance by the user.

This contract, and therefore the general conditions it includes, together with the annexes (if any), in addition to being read on this website, may be stored, archived and reproduced by standard electronic or computer means.

COMPLAINTS AND CLAIMS

The User may send EUROALIMENT PAC, SLU any complaints, claims or any other comments they wish to make through the contact details provided at the beginning of these Conditions (General Information). In addition, EUROALIMENT PAC, SLU has official complaint forms available to consumers and users, which they may request from EUROALIMENT PAC, SLU at any time, using the contact details provided at the beginning of these Conditions (General Information). Likewise, if a dispute arises from the relationship between EUROALIMENT PAC, SLU and the User, the User as a consumer may request an extrajudicial dispute resolution, in accordance with Regulation EU No. 524/2013 of the European Parliament and of the Council, of May 21, 2013, on the resolution of online disputes in consumer matters.
