The present conditions of purchase apply to all sales of EUROALIMENT PAC, S.L.U articles made through the website pons.shop (from here on, “website”).
By making a purchase, you guarantee that are 18 years of age or older and that you are legally able to sign binding contracts.
The retailer commits to not permitting any transaction which may be illegal or which may be deemed, by the credit card companies or acquiring bank, to have the potential to harm the good faith of the credit card companies or acquiring bank or to negatively impact them. 2. ORDERING CONDITIONS
All products offered on this website are sold directly by EUROALIMENT PAC, S.L.U. with CIF (tax number) B25368432 and business address Al-Kanis Industrial Park, Nave A, Ctra N-230 Km 11.2, Rosselló, 25124 Lleida.
2.1. How to shop
You may browse the website until you find your desired item. Once you have located your item, click on it to access all the detailed information provided by the website. From there, you may add the item to your purchase.
If this is your first time ordering from us, you will be asked to provide your information (name and surname, email address, street address, payment method, etc.) and create an account.
If you are already a registered user with an active account, submit your email and password and the system will recognise your data.
Once you have accessed your account, you may continue shopping and finally confirm your order.
2.2. Scope of the offer
Orders are accepted and distributed throughout the Peninsula (Spain, Andorra and Portugal).
If you would like to receive an item in Ceuta, Melilla, Spanish/Portuguese islands or a country of the European Union which is not Spain or Portugal, we advise you to contact us through the contact form or by sending an email to [email protected] and we will respond to your query.
2.3. Availability
All orders are subject to availability. We will not claim responsibility for product non-existence or unavailability.

If a product becomes unavailable after you make your order, we will inform you as soon as possible by email or phone, and your order will be fully or partially cancelled.

2.4. Contract with EUROALIMENT PAC, SLU and acceptance of orders.
We will not accept your order until your payment has appeared in our account. After completing your purchase, you will receive a confirmation email, but this email will not imply that your order has been accepted, as it will be subject to our posterior checking and acceptance.
After your order has been accepted, you will receive an email stating that your order is being sent. Only then will the contract between you (the purchaser) and us (the retailer) be taken as formalised, and only for the items listed in the aforementioned shipping confirmation.
2.5. Confirmation and cancellation of orders
Before you finish making an order from our website, you will have the opportunity to review all the details associated with it (costs disaggregated into all the necessary segments -- taxes, shipping and item selection costs, etc.) and make any changes you deem necessary.
After your order has been confirmed, you will not be able to modify or cancel your order through the website. You will have to get in touch with us. In any case, your order may only be modified or cancelled if the item has not yet been dispatched from our warehouses.
2.6. Currency, taxes and price
In accordance with the law in force, all purchases made through our website will be subject to the value-added tax. The applicable rate will be that which is legally in force at the time of purchase.
All prices will be shown in euros and should be considered the final price to be paid by the customer (added-value tax [in Spain, IVA] and any other taxes which may pertain), not including shipping costs.
2.7. Payment methods and security
All orders must be paid immediately upon order confirmation. Only orders whose payment has been completed and verified will be processed.
Payment must be made by card.
Credit cards accepted: VISA, VISA Electron, 4B and MasterCard. Your order will be billed to your card, so you must provide us with your card number, expiration date and CVV security code (on the back of your card). If your card has been scratched, you will be asked for the relevant security codes.
This information will not be saved or handled by us; rather, they will be directly registered through the payment gateway of the corresponding financial entity. The transaction will be processed in real time through this Redsys payment gateway. If, in the end, the transaction cannot be completed (for any reason), the order will automatically be cancelled.
PayPal: Allows you to pay directly without putting your financial information online. Automatically codifies your personal data with the help of the technological improvements available on the market.
Bank transfer: the customer will have 5 business days to make the payment, or the order will be automatically considered to be cancelled. The customer must pay for their order to the account shown below, indicating the order number generated at the end of the purchasing process. This system may be used for purchases of any monetary amount. When you have finished ordering, you will receive an email with all the details.

2.8. Deliveries: types, periods and problems
Orders shipped within the Peninsula (Spain, Andorra and Portugal) are normally delivered in 24 to 48 hours, up to a maximum period of 5 business days, an occasional event due to stock rotations or similar situations and in which case our customer service case will keep you punctually informed. These shipments are made using the transportation agency MRW.
If you prefer to pick up your order at our store, you may do so from Monday to Friday, 24 hours after receiving an email confirming that your order has been delivered to the store. If you receive the email on Friday, you will not be able to pick up your order until the following Monday.
Orders made after 16:00 h (4 pm) will be prepared and shipped, whether to a residence or the store, on the following day. If pons.shop is unable to deliver your order within the aforementioned period, our customer service department will let you know and give you the choice of confirming or cancelling your order.
If the payment is made via bank transfer, the delivery period will begin after the payment is received and validated by EUROALIMENT PAC, S.L.U.
Note: All orders will be processed on business days, Monday through Friday. Orders made on national, autonomous-community and local holidays will be processed the day after the holiday in question.
Delivery time may increase in sales periods, Christmas campaigns or in the event of customs procedures or other circumstances derived from (to name a few examples) geographic distance, meteorological conditions, wars, strikes, any form of governmental intervention, supplier non-compliance, etc. as well as any other cause attributable to the logistics operator responsible for delivering the product. We will not claim responsibility for any delay which may be caused by any of the reasons mentioned above.
If, at the time of delivery, the package of the order is damaged, you should open the package in the presence of the logistics operator to verify the state of the items. If your items appear to be damaged, you should describe the damage in writing on the delivery note and notify us. We will repair or replace, at no additional cost to you, any items which have been damaged or lost during shipping, as long as you notify us about the incident as soon as possible.
Once your order has been delivered, it will become part of your property and from then on, any damage which may occur will be your responsibility.
2.9. Shipping costs
Shipping within the Peninsula (Spain, Andorra and Portugal)
On orders of a value equal or superior to €55, shipping is free.
On orders of a value inferior to €55, shipping costs will vary according to the value of the purchase made.

2.10. Return, cancellation, exchange and refund policy
You may return your product within a period of 14 calendar days after receiving your order.
To start the order return procedure, send an email to [email protected] indicating the order number and product to return. We will respond by email, within the following 3 business days, with instructions on how to complete the return.
The return shipping costs will be charged to you, the customer, who will be responsible for ensuring that the return is made correctly with the delivery company of your choice.
VERY IMPORTANT: Keep the delivery receipt as, in the event of a shipping incident, the receipt will serve as proof against possible claims. If not, EUROALIMENT PAC, S.L.U. will not take responsibility for the return.
Right of cancellation
You, the customer, may exercise your right of cancellation within a period of 14 calendar days counting from the date your order is received.
To make the cancellation effective, you must notify the Company of it, sending a notification, in writing, to the Company of your decision to cancel the contract by means of an unequivocal declaration (for example, a letter sent by mail or email). You may use the model cancellation form shown below, although its use is not mandatory.

To comply with the cancellation period, it is enough that the notice related to your exercise of this right be sent before the end of the corresponding period.
The right of cancellation is limited and does not include the possibility of cancelling in the following situations:
· Goods which have been used or damaged.
· Goods which may rapidly deteriorate or expire.
· Goods designed according to the specifications of the consumer and user or which are clearly custom-made.
· Sealed goods which are not valid to be returned for the purpose of protecting health or hygiene and which have been unsealed after delivery.
Returns will only be accepted on products in perfect condition and they must be returned in a correctly protected state, in their original packaging, in perfect state, unopened, without signs of having been opened, with all accessories and the receipt.
Once the product has been received, if it shows any type of handling, damage or sign indicating that it has been, or is at risk of having been, opened, modified, or altered, the product in question will be immediately returned to the customer by post paid on delivery, with all shipping costs billed to the user.
The right of cancellation is dependant on you, the user, returning the product exactly as it was received, unused and in its original packaging, in such a way that its deterioration during shipping is impossible, accepting responsibility for any damage which may be incurred by the product during shipping.
Once the items have been examined and verified, EUROALIMENT PAC, S.L.U. will proceed to return your payment the same way it was made in a period no longer than 14 days from the date the products were received.
Returns will be processed on business days, Monday through Friday. Returns made on national, autonomous-community and local holidays will be processed the day after the holiday in question.
3. PARTIAL NULLITY
If any part of these conditions of service were to be deemed unlawful and, therefore, invalid, this would not affect the rest of the provisions in conformance with the law. The parties commit to renegotiating the points of the service conditions which are deemed null and void and to incorporating the renegotiated points into the rest of the service conditions.
4. MODIFICATION OF THE GENERAL CONDITIONS OF SALE
EUROALIMENT PAC,S.L.U. reserves the right to modify the general conditions of sale without prior notice, being able to change, delete or add both the contents and services presented therein as well as the way these contents and services appear presented or located on company servers.
These changes must be accepted by you, the user, every time you make a purchase through the website.
Customers who do not agree with changes made to the general conditions should give notice of their disagreement and, starting from the date when the new version enters into force, should stop using the website.
In the event that some of the terms of the general conditions of sale are declared comprehensive or non-opposable by a legal decision, the other provisions will remain in force.
5. GOVERNING LAW AND JURISDICTION
This site is located in and operated from Spain. All issues pertaining to this site are governed by Spanish law and are subject to the jurisdiction of the competent Courts and Tribunals of Spain, without regard to conflict of law principles.
Customers who do not have the condition of consumer or user, or who reside outside of Spain, will be subject to the Courts and Tribunals of Lleida, expressly waiving any other jurisdiction which may pertain to them.

The present contract will enter into force and take full effect from the moment the customer or user accepts it.

Furthermore, if any dispute arises from the signing of this contract of purchase between EUROALIMENT PAC, S.L.U. and the Consumer, the Consumer may request an extrajudicial dispute resolution, in accordance with Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution of consumer disputes.
